Terms of Service
These terms are the agreement between your church and SundayOS. By creating an account or using the platform, your church agrees to them.
1. Who these terms are with
SundayOS is provided by SundayOS (operated by Talesoft Digital) — TODO confirm registered entity (company number TODO — company registration number), registered at TODO — registered office address, United Kingdom, United Kingdom. In these terms, "we", "us", and "SundayOS" mean that company, and "you" means the church or organisation that holds the account.
2. Your account
You must give accurate account details and keep your sign-in credentials secure. You are responsible for what happens under your account and for the people you invite and the permissions you grant them. Tell us promptly if you believe an account has been compromised.
3. Free trial
New churches can try the full platform free for 30 days, with no card required to start. At the end of the trial you can subscribe to continue; if you do not, your access to paid features ends. We may change trial terms for future sign-ups, but not retroactively for a trial already under way.
4. Subscription and payment
Continued use after the trial requires a paid subscription at the price shown on our pricing page. Subscriptions renew automatically for successive periods until cancelled. Payments are handled by our payment provider; by subscribing you also agree to their terms for the payment itself. Fees are exclusive of any taxes that may apply.
5. Cancellation and refunds
You can cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period, and you keep access until then. Except where the law requires otherwise, fees already paid are non-refundable.
6. Acceptable use
You agree not to:
- use SundayOS to break the law or infringe anyone's rights;
- send unlawful, abusive, or unsolicited messages through the platform, or use it to harass anyone;
- upload malicious code, or attempt to gain unauthorised access to the platform, other churches' data, or our systems;
- probe, scrape, or overload the service, or resell it without our written agreement.
You are responsible for having a lawful basis to hold the personal data you enter about your people, and for using SundayOS in line with your own safeguarding and data-protection duties.
7. Your data and privacy
Your church's data remains yours. We process it as described in our Privacy Policy, which forms part of these terms. We handle personal data you enter as your processor, on your instructions.
8. Availability and support
We work hard to keep SundayOS available, especially around Sunday service times, but we do not guarantee uninterrupted access. We may carry out maintenance and will aim to minimise disruption. Support is available at hello@sundayos.com.
9. Changes to the service and these terms
We may improve, change, or discontinue features over time. We may also update these terms; when we make a material change we will update the date above and, where appropriate, notify account administrators. Continuing to use SundayOS after a change means you accept the updated terms.
10. Intellectual property
We own the SundayOS platform, software, and branding. You own the content and data your church puts into it. You grant us the limited permission needed to host and process that content so we can provide the service to you.
11. Liability
Nothing in these terms limits liability that cannot be limited by law (such as for death or personal injury caused by negligence, or for fraud). Subject to that, SundayOS is provided "as is", and to the extent permitted by law we are not liable for indirect or consequential loss, or for loss of data where you have not kept your own records. Our total liability to you in any 12-month period is limited to the fees you paid us in that period.
TODO (legal, before launch): confirm the liability cap and exclusions are appropriate for the business and its insurance position.
12. Termination
You can stop using SundayOS and close your account at any time. We may suspend or end your access if you seriously or repeatedly breach these terms, giving you notice where it is reasonable to do so. On termination, our Privacy Policy governs how long we retain and when we delete your data.
13. Governing law
These terms and any dispute arising from them are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
